Terms and Conditions for arkynn.com and ARKbase

  1. Acceptance of Terms

By accessing the website at arkynn.com or using the ARKbase software-as-a-service (SaaS) product, you are agreeing to be bound by these Terms and Conditions, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.

  1. Description of Service

ARKbase is a SaaS product that includes Customer Relationship Management (CRM), Human Resource Management (HRM), and Applicant Tracking System (ATS) functionalities. The service is provided “as is” and “as available” without any warranties, express or implied.

  1. User Account

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password.

  1. Data Responsibility and Backup

4.1 The customer is solely responsible for entering, updating, and backing up their data. Arkynn.com does not guarantee the preservation of any customer data and is not responsible for any loss, corruption, or inaccuracy of data.

4.2 While we employ industry-standard security measures, we do not guarantee that your data will be completely secure or free from unauthorized access.

4.3 It is the customer’s responsibility to maintain copies of all data entered into ARKbase. We strongly recommend regular backups of your data.

  1. Limitation of Liability

5.1 Arkynn.com and its suppliers shall not be liable for any damages arising out of or in connection with the use or inability to use ARKbase, including but not limited to damages for loss of data or profit, or due to business interruption.

5.2 In no event shall Arkynn.com or its suppliers be liable for any indirect, consequential, incidental, special, or punitive damages, including lost profit, lost revenue, lost data, or business interruption.

  1. Modifications to Service

Arkynn.com reserves the right to modify or discontinue, temporarily or permanently, the ARKbase service with or without notice. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the service.

  1. Privacy Policy

Your use of ARKbase is also governed by our Privacy Policy, which is incorporated into these Terms and Conditions by reference.

  1. Intellectual Property

The ARKbase service, including all content, features, and functionality, is owned by Arkynn Group Ltd and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

  1. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

  1. Governing Law

These Terms shall be governed and construed in accordance with the laws of Hong Kong, without regard to its conflict of law provisions.

  1. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our service after any revisions become effective, you agree to be bound by the revised terms.
